Refund and Cancellation Policy

Effective date: 17 September 2026

This policy applies to services provided by Alexander Amiss trading as Nothing Amiss (ABN 48 481 803 026). It forms part of our Terms of Engagement. If a statement of work (SOW) sets different terms, the SOW applies for that engagement.

Your rights under the Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this policy limits those rights. If we fail to meet a consumer guarantee, you may be entitled to have the problem fixed, the service supplied again, or a refund, depending on the nature of the failure.

This policy explains what happens when you change your mind or cancel. It does not replace your legal rights where we are at fault.

1. Meetings, discovery calls and workshops

  • Free discovery calls: reschedule or cancel at any time. Please give as much notice as you can.
  • Paid sessions, audits and workshops: cancel or reschedule with at least 2 business days’ notice for a full refund or free reschedule. With less than 2 business days’ notice, the session fee is non-refundable, but we will offer one reschedule within 30 days where we can.
  • If we cancel a paid session, you can choose a full refund or a reschedule.

2. Deposits

Deposits secure time in our schedule and cover initial planning. Deposits are non-refundable once work has started or if you cancel within 5 business days of the scheduled start date, except where the cancellation is due to our failure to perform. If you cancel earlier and no work has been done, we will refund the deposit less any non-cancellable third-party costs incurred on your behalf.

3. Fixed-fee projects

If you cancel a fixed-fee project after work has started, you pay for work completed up to the cancellation date, calculated on a reasonable proportion of the fixed fee, plus approved expenses and non-cancellable commitments. We will refund any prepaid amount above that and deliver completed work in its current state.

4. Time and materials

You pay for time actually worked and approved expenses up to the date of cancellation. Unused prepaid amounts are refunded.

5. Retainers

  • Retainers may be cancelled with 30 days’ written notice, or the notice period in your SOW.
  • Retainer fees for a period that has already started are not refunded.
  • Unused retainer hours do not roll over or convert into refunds unless the SOW says otherwise.
  • If we terminate a retainer for convenience, we refund any prepaid fees for periods that have not started.

6. Third-party costs

Software subscriptions, licences, add-ons or services bought in your name or on your behalf (such as HubSpot seats, integrations or middleware) are subject to the vendor’s own refund terms. We cannot refund those amounts.

7. How to cancel or request a refund

Email xander@nothingamiss.com with your name, business name, the engagement or invoice number, and the reason for your request. We will respond within 5 business days. Approved refunds are processed within 14 days to the original payment method.

8. Disputes

If you are unhappy with our work, please tell us promptly so we can try to fix it. Our dispute resolution process is set out in our Terms of Engagement. You may also contact your state or territory fair trading agency (in NSW, NSW Fair Trading).
